Comprehensive Purchase Agreement

and Responsibilities

By accessing or engaging in activity with you agree to be bound by these terms, which you acknowledge that you have read and understood.

Breeder guarantees that the cat being sold is a Pedigree Scottish Fold cat NOT FOR BREED.

  1. Pet-Only Purchase [No Breeding Rights]: This cat or kitten is being sold strictly as a pet, with no breeding rights. The Breeder will have the kitten spayed or neutered before the sale. Once proof of the procedure is provided, the registration papers for the kitten will be issued to the Purchaser.

  2. The kitten will receive two rounds of FVRCP vaccinations and deworming treatments before being transferred to the Purchaser.

  3. If Buyer transfers cat/kitten to another owner, the Buyer agrees to let Seller know and approve the transaction.

  4. The Breeder guarantees that the kitten/cat is healthy to the best of his/her knowledge at the time the Buyer takes ownership of the kitten. Buyer is advised to take this kitten/cat to a veterinarian for a complete health check within 48 business hours, excluding weekends and holidays. If the cat/kitten is found to be unfit for sale due to a congenital or hereditary disorder, Buyer may opt for one of the following:

    1. (a) The right to return the animal and receive a refund of the purchase price within 10 business days following receipt of a signed veterinary certification, including sales tax, but excluding the veterinary costs related to the certification that the cat is unfit; or

    2. (b) The right to return the animal and receive an exchange cat of the consumer’s choice of equivalent value, but not a refund of the veterinary costs related to the certification that the cat is unfit.

  5. The Buyer must notify the Breeder within 2 business days after the veterinarian’s determination that the animal is unfit.

  6. The written certification of unfitness must be presented to the Breeder not later than 3 business days following receipt thereof by the Buyer.

  7. After 48 hours from the time the kitten leaves the breeder’s home, the breeder cannot be held accountable for FeLV (Feline Leukemia Virus), FIV (Feline Immunodeficiency Virus), or any other bacterial or viral infections, infectious diseases, parasites, or fungus. These conditions can be contracted from the environment after leaving the cattery and are not a result of genetics or breeding.

  8. For FIP (Feline Infectious Peritonitis), the breeder provides a specific guarantee of 72 hours. If FIP is diagnosed within this period, the breeder will replace the kitten, subject to providing a necropsy report from a licensed veterinarian. An animal may not be deemed unfit for sale due to injuries sustained or illnesses contracted after the consumer takes possession.

  9. FIP Awareness and Disclaimer:

    1. Understanding FIP: The Buyer acknowledges that FIP is a complex and currently untreatable viral disease caused by certain strains of feline coronavirus (FCoV). The disease is rare but serious, and it is currently believed to be triggered by a mutation of the common feline coronavirus.

    2. Breeder's Best Efforts: The Seller guarantees that to the best of their knowledge, the kitten/cat is healthy at the time of sale and shows no signs of FIP. However, because FIP is believed to be caused by a mutation of the feline coronavirus, and because the mutation can occur after the cat leaves the breeder’s care, the Seller cannot guarantee that the kitten/cat will not develop FIP in the future.

    3. No Warranty for FIP: Due to the nature of the disease and its potential to develop without any genetic predisposition or breeder influence, the Seller cannot be held responsible for the onset of FIP after the kitten/cat leaves the Seller’s home.

    4. Post-Sale FIP Diagnosis: If the kitten/cat is diagnosed with FIP after the 72-hour health guarantee period, the Buyer agrees that the Seller is not responsible for refunding the purchase price or any related veterinary expenses. The Buyer assumes full responsibility for the care and treatment of the kitten/cat if such a diagnosis is made.

  10. A veterinary finding of intestinal or external parasites is not grounds for declaring a cat unfit for sale.

  11. The cat is covered by a five-year warranty (from the date of birth) or until the Cattery is closed, whichever comes first, against 35 specific genetic defects identified by the Optimal Selection DNA test of both parents. If any of these defects result in the cat's death, the Breeder will replace the kitten with one from the next three litters, provided the Breeder receives a necropsy report from a licensed veterinarian confirming the defect. The Buyer must make reasonable efforts to treat the condition and prevent the cat's death; what constitutes "reasonable" will be determined by the Breeder.

  12. In the event of a genetic defect which is a life altering condition that may negatively affect the kitten within the first five years of life, and euthanasia is chosen as the best option for the cat, because there is no quality of life, both the buyer AND the breeder MUST agree in writing that Euthanasia is the best option. There are absolutely no exceptions to this clause.

  13. Lack of funds to provide care for a kitten/cat is not a reason to choose euthanasia.

  14. If the condition is not specifically listed on this contract, then it’s specifically excluded from the health guarantee.

  15. There will be no cash refunds under any circumstances, except at the Breeder’s discretion if he/she opts to refund the purchase price rather than replace the cat.

  16. Purchasing a kitten from the Breeder makes you solely responsible for the health and wellbeing of the kitten from the day it arrives at home until the last day of its life. It is NOT the responsibility of the breeder to pay for any veterinarian expenses, treatments, or medicines that may be required to improve the life of your kitten or cat. While everything is done to ensure that we deliver a healthy and viable kitten/cat, there’s no way for us to predict the future health of any kitten. It is a living animal and there’s always a risk that it may develop a health condition in the future.

  17. Buyer agrees to keep vaccinations and health checks up to date

  18. This cat/kitten WILL NOT be declawed.

  19. Purchaser will always provide a clean litter pan, always fresh water, quality food, and suitable scratching posts.

  20. If cat/kitten is found to be kept in an unsuitable environment, is poorly cared for the Seller will reserve the right to request that the cat/kitten be unconditionally returned at no cost to the Seller with NO REFUND of purchase price.

  21. The kitten/cat will be kept indoors and not allowed to roam freely outside unless the kitten is leashed and accompanied by a responsible adult.

  22. The Buyer agrees that under no circumstances will the kitten/cat EVER be sold, leased, or given to any pet shop, animal shelter, research laboratory, or similar facility.

  23. The Seller reserves the right to inquire about the cat's/kitten's health conditions at any time.

  24. This contract is legally binding to all parties involved. This sales agreement is non-transferable to other parties. Any changes, additions, or omissions to this contract must be agreed upon in writing and dated and initialed by all parties.

  25. Breach of this agreement will result in cancellation of any warranties, or guarantees, of this kitten. The Breeder’s maximum liability to the Buyer for any and all losses, claims, damages, or liability of any kind shall be limited to the amount paid by the Buyer to the Breeder under this agreement. Any law suits pertaining to this agreement will be handled in the state of Pennsylvania, Bucks County.

  26. The kitten is eligible to leave the nursery and go to its new home starting at 12 weeks of age, or on the date specified in the agreement. The kitten must be picked up within one week from the date specified in the agreement. If the kitten is not picked up by this date, a boarding fee of $35 per day will apply, along with any additional costs for maintaining vaccinations or providing veterinary care. The maximum boarding period is 30 days.

  27. After 30 days of boarding, it will be assumed that the kitten will not be going to the new buyer. Any monies paid to the breeder will be forfeited and the kit ten will no longer be available to the mentioned buyer.

  28. Breeder reserves the right to cancel this contract at any time prior to the kitten leaving the cattery if the Breeder feels that it is in the best interest of the kitten and/or the Breeder. In that instance, the Buyer will be refunded 100% of their deposit.

  29. The Health Guarantee covers the conditions listed below:
